Terms of Service
These terms govern your use of Brandealr. By using the service you agree to them.
What Brandealr does
We manage brand deal correspondence for creators. With your permission we read and reply to brand enquiries on your behalf, negotiate terms, prepare and review contracts, and help arrange payment.
Access to your accounts
To do this you may connect an email or messaging account to Brandealr. You grant us permission to read and send messages from that account for the purposes of the service.
To disconnect, send a cancellation request from your creator portal or email info@brandealr.com. We will confirm within two business days and disconnect the account when we do.
You can also revoke our access yourself at any time from your Google account permissions page, which ends it immediately. If you do, we disconnect the account on our side and remove you from our public creator roster. We can no longer read or reply to brand email for you, so deals in progress may stall until you reconnect or tell us how you want them handled. Fees on deals already agreed remain payable.
You should connect an account you use for brand deals rather than a personal one.
Acting on your behalf
We negotiate within the rates and terms you agree with us. We will not accept a deal below a floor you have set. Where a message is sent automatically, that is because you have switched that on, and you remain responsible for what is sent from your account.
No deal is binding until you confirm it. We do not sign contracts for you.
Your responsibilities
- Give us accurate rates, figures and preferences
- Deliver the content you have agreed to deliver, on time
- Comply with the platform rules and advertising disclosure requirements that apply to you, including FTC disclosure of paid partnerships
- Tell us promptly if you no longer want us acting on a conversation
Fees
Our fee is agreed with you before we start and is a share of deals we bring in or negotiate. Where payment routes through our payment provider, our share may be taken automatically at the point the brand pays. Where we collect on your behalf, we pay your share to the account you give us.
Content and ownership
You own the content you create. Nothing here transfers ownership to us. Usage rights granted to a brand are whatever the deal says, and we will tell you when a brand is asking for more than standard organic posting.
What we do not promise
We cannot guarantee that a brand will reply, agree terms, pay on time, or that any particular deal will be reached. Automated drafting can make mistakes, which is why messages are reviewed before sending unless you have chosen otherwise. The service is provided as is.
Limitation of liability
To the maximum extent permitted by law, Brandealr is not liable for indirect or consequential loss, lost profits or lost opportunity. Our total liability for any claim is limited to the fees you paid us in the twelve months before the claim.
Ending the arrangement
Either side can end this at any time with written notice. A cancellation request from your creator portal counts as written notice. On termination we stop accessing your accounts and delete stored credentials. Fees on deals already agreed remain payable. You can ask us to delete your data as set out in our Privacy Policy.
Changes
We may update these terms. Where a change is material we will tell you before it takes effect.
Governing law
These terms are governed by the laws of the State of New York, United States.
